Building an ADU in Oceanside

Oceanside's own ADU ordinance is in limbo. The city says it is still working with the state housing department (HCD) to certify Section 3006 of its zoning ordinance, and that until then the state ADU standards in HCD's ADU Handbook apply. In June 2026 HCD found that the city's March 2026 ordinance fails to comply with state law, in a letter with 26 numbered findings. State standards include a size cap of no less than 850 sq ft, 4-foot side and rear setbacks, limited parking, and no impact fees on ADUs of 750 sq ft or less. What you can build in Oceanside

Oceanside's ADU page says the city "is in the process of certifying Article 30, Section 3006 of the Zoning Ordinance (ADU Ordinance) with HCD." Because of that, the city says any information it gave earlier that relied on Section 3006 is "no longer applicable," and that "the applicable State Law ADU standards are outlined in the HCD Accessory Dwelling Unit Handbook."

Under state law as HCD reads it, on a lot with a single-family home you can build one ADU converted from space in the house or an accessory building, one new detached ADU, and one junior ADU (JADU), all at the same time.

On a lot with an apartment building, state law allows ADUs in non-living space such as storage rooms, attics, basements or garages. It also allows up to eight detached ADUs on a lot with an existing multifamily building (no more than the number of existing units), or two with a proposed one.

HCD's findings on Oceanside's ordinance

The state housing department has reviewed Oceanside's ADU ordinance twice and found problems both times.

May 2025. HCD reviewed Ordinance No. 22-OR0114-1 (adopted February 23, 2022) and found it did not comply with state law. Among other things, it limited single-family lots to one ADU. HCD said "this permits a homeowner, who meets the specified requirements, to create one converted ADU; one detached, new construction ADU; and one JADU."

June 2026. HCD reviewed the replacement, Ordinance No. 26-OR0104-1 (adopted March 25, 2026), and again found it "fails to comply with State ADU Laws." The city had until July 17, 2026 to respond with a plan to amend the ordinance or adopt findings. Provisions HCD told the city to change include:

Under state law, if a city doesn't respond to HCD's findings within 30 days, its ordinance is void and only state ADU law applies. We could not confirm how Oceanside responded. Size, height and setbacks

With the city pointing to state standards, these are the state rules HCD describes. ADU sizes are measured in interior livable space: bedrooms, bathrooms, kitchens, laundry rooms, closets and interior stairs.

Oceanside's March 2026 ordinance set stricter limits in some of these areas, and HCD told the city to fix them (see above). Confirm with the Planning Division which limits it will apply to your project. [2][3]

Parking

Under state law, a city can require at most one parking space per ADU or per bedroom, whichever is less, and the space can be tandem on your driveway. No parking can be required for an ADU within a half-mile walk of public transit, in a historic district, built as part of the house or an accessory structure, where on-street permits are required but not offered to the ADU tenant, or within a block of a car-share vehicle.

If you tear down or convert a garage, carport, covered parking or an uncovered space to build an ADU, the city can't make you replace that parking. Oceanside's 2026 ordinance required one off-street space per ADU (with exceptions) and left out uncovered spaces from the no-replacement rule. HCD told the city to add the uncovered-space rule and an exemption for ADUs with no bedroom. [2][3]

Fees

Impact fees. State law bars impact fees on an ADU with 750 sq ft or less of interior livable space, or a JADU of 500 sq ft or less. Above 750 sq ft, impact fees must be proportional to the size of the main house. HCD's example: a 1,000 sq ft ADU next to a 2,000 sq ft house could pay 50 percent of the fee for a new house.

Oceanside's impact fee schedule for fiscal year 2026-27 (marked "For Information Only, Not Intended to be a Final Calculation") lists, for example, a Public Facility fee of $2,621 per residential unit, a parks fee for single-family units with a $4,105 minimum (681 sq ft or smaller) and $6.03 per sq ft above that, and traffic signal and thoroughfare fees of $3,109.88 to $4,339 per dwelling unit. The schedule doesn't say how these apply to ADUs, so ask the city to confirm which fees, if any, your ADU will pay.

School fees. School districts may charge fees on ADUs over 500 sq ft; ADUs and JADUs under 500 sq ft are exempt. The city's fee schedule sends you to the school districts for their fees, including Oceanside Unified's developer fees page.

Water and sewer. Under state law, utilities can't treat an ADU or JADU as a new residential use when calculating connection fees or capacity charges, unless it is built at the same time as a new single-family home.

Permit fees. Plan check and permit fees are invoiced when you apply, and your review clock doesn't start until documents are in and fees are paid. For typical total costs see our ADU cost guide. [3][4][6]

How long it takes

The Building Division's target for the first plan review of an ADU is 14 calendar days, and 7 calendar days for resubmittals. The city says these targets "may fluctuate based on the volume of plans." Plans are reviewed first-come, first-served, and the review time doesn't start until you've uploaded your documents and paid fees.

Under state law, the city must tell you within 15 business days whether your application is complete, and approve or deny a complete application within 60 days when there's already a home on the lot. A detached ADU using a pre-approved plan must be decided within 30 days.

Coastal zone

Part of Oceanside is in the California Coastal Zone. Check your lot with the city's Land Use & Zoning GIS Map Viewer, which shows whether a property is coastal or non-coastal.

HCD says state ADU laws apply in the coastal zone but don't lessen the Coastal Act's resource protections. Where a certified local coastal program covers ADUs, the city must approve or deny a coastal development permit for an ADU within 60 days of a complete application (when there's an existing home), and it can't require a public hearing.

Garage conversions and junior ADUs

Garage conversions. Under state law, an ADU converted from an existing accessory building such as a garage needs exterior access and setbacks adequate for fire and safety, but no 4-foot side and rear setback. It can add up to 150 sq ft for entry and exit. You don't have to replace the garage parking. If you tear down a detached garage to build an ADU, the demolition permit must be reviewed and issued together with the ADU permit; HCD noted Oceanside's 2026 ordinance was missing this rule. An ADU doesn't need fire sprinklers if the house doesn't have them, and building one can't trigger sprinklers in the house. More in our garage conversion guide.

Junior ADUs. A JADU is up to 500 sq ft of interior livable space, entirely inside a single-family home (including an attached garage). It may have its own bathroom or share one with the house. If it shares a bathroom, the owner must live in the house or the JADU. HCD told Oceanside to remove language allowing JADUs in a detached accessory structure. See our junior ADU guide. [2][3]

Renting it out, selling it, and SB 9

You don't have to live on the property to have an ADU; state law bars owner-occupancy rules for ADUs. JADUs and the state-guaranteed ADU types must be rented for more than 30 days.

Short-term rentals. The city's short-term rental page says STRs (30 days or less) "are prohibited at properties with an Accessory Dwelling Unit (ADU) or Junior Accessory Dwelling Unit (JADU) that was permitted on or after September 9, 2017," and that this covers the main house too. That page cites Section 3006(E)(3), the same ADU section the city now says is being recertified. Ask Planning at (760) 435-3520 (zoning questions) before planning any short-term use.

Selling. Oceanside's 2026 ordinance says an ADU or JADU can't be sold separately from the house, except under the state's nonprofit program. HCD noted the city may allow ADU condominiums under state law and suggested it consider doing so.

SB 9. The city's SB 9 page says single-family zones include R-1, RS, RE and some PD properties. With a two-unit SB 9 project, each unit may have one ADU or JADU, up to four units total, and SB 9 units pay all required fees, including impact fees. After an SB 9 lot split, ADUs and JADUs aren't allowed beyond the two units per lot, you must live on one of the new lots for at least three years, and no unit can be rented for less than 30 days. Permit steps in Oceanside

  1. Check your zone and coastal status

    Look up your lot in the Land Use & Zoning GIS Map Viewer to see its zoning and whether it's in the coastal zone, and read the city's ADU page. [1][8]

  2. Confirm the rules with Planning

    Because the city's ADU ordinance is being recertified, email PlanningStaff@oceansideca.org to confirm which standards apply and whether you need a Coastal Permit (coastal permits are submitted by appointment). [1][9][12]

  3. Prepare plans

    Unlicensed designers may prepare plans only for up to four wood-framed dwellings on one lot, no more than two stories tall. Depending on scope, you route plans to other departments before the Building Division review. To use a pre-approved plan, get the vendor's approval first. [4][7][11]

  4. Apply online

    Submit the electronic Building Permit Application or use eTRAKiT. Paper plans aren't accepted. Staff send an invoice and a Box link to upload your plans as PDFs. [4]

  5. Pay fees and go through plan review

    Review starts once documents are uploaded and fees paid. The plan checker issues a correction list; you resubmit until the plans are approved. Check status at (760) 435-3950 or in eTRAKiT. [4][7]

  6. Get the permit, build and pass inspections

    Permits are issued to licensed contractors or owner-builders who have owned the home for 12 months. Request inspections at (760) 435-3925. Finish within three years of issuance. [4][13]
